Effective 31 August 2026. These Terms apply to coaching, consulting, mentoring, education, digital programs and other services supplied by The Genius Portal Pty Ltd (“we”, “us”, “our”). By purchasing, booking, accessing or participating in a Service, you (“you”, “client”) agree to these Terms and any specific written offer, proposal, checkout terms or payment plan provided to you. If specific written terms conflict with these Terms, the specific terms apply to that extent.
1. Services & participation. We will provide the Services substantially as described at the time of purchase. Dates, delivery methods, content, facilitators or reasonable program details may change where necessary. You are responsible for your participation, decisions, implementation and results. Unless expressly stated otherwise, access is personal, non-transferable and must be used within the access period stated for the Service.
2. Fees & payment. You must pay all fees and instalments when due. A payment plan is a commitment to pay the full agreed price, not a month-to-month subscription, unless expressly stated otherwise. If a payment is overdue, we may suspend access and use reasonable recovery processes. You are responsible for reasonable third-party recovery costs to the extent permitted by law. Prices include GST where stated or required.
3. Cancellations & refunds. Change-of-mind refunds are not provided unless we expressly offer a cooling-off period, guarantee or refund right for the relevant Service. If we offer one, its stated conditions apply. Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including under the Australian Consumer Law. If we cancel a Service and do not provide a reasonable alternative, we will refund the amount paid for the undelivered portion.
4. No guaranteed outcomes; professional advice. Our Services are educational and/or developmental in nature. Results vary and we do not guarantee income, business, creative, personal or other outcomes. Testimonials and examples are illustrative only. Nothing we provide is legal, financial, medical or mental-health advice. You should obtain appropriately qualified professional advice where required.
5. Intellectual property & confidentiality. We retain all intellectual property rights in our materials, methods, recordings, templates and content. We grant you a limited, personal, non-exclusive licence to use supplied materials for your own purposes only. You must not reproduce, sell, share, teach, publish or commercially exploit them without written permission. Each party must reasonably protect confidential information received from the other, except where disclosure is authorised or required by law.
6. Conduct & access. You must not misuse our platforms, infringe another person’s rights, harass participants or disrupt delivery. We may suspend or end access for serious or repeated misconduct or material breach. Any financial consequences will be subject to applicable law and the circumstances of the termination.
7. Liability. To the extent permitted by law, we exclude liability for indirect or consequential loss and for loss arising from matters outside our reasonable control. Where liability can lawfully be limited, our aggregate liability relating to a Service is limited to the amount you paid for that Service. This clause does not limit liability or remedies that cannot legally be limited or excluded.
8. General. If part of these Terms is invalid or unenforceable, the remaining terms continue. A delay in enforcing a right is not a waiver. Neither party is liable for delay caused by events beyond reasonable control, except payment obligations already due. These Terms are governed by the laws of Western Australia and the parties submit to the courts having jurisdiction there. Before commencing formal proceedings, the parties should first attempt in good faith to resolve the dispute directly.
